Do Undocumented Immigrants Need Car Insurance in California?

Yes. If you drive in California, you’re legally required to have car insurance–even if you’re undocumented.  The law says all drivers need at least:

  • $30,000 for injuries or death to one person
  • $60,000 total if more than one person is hurt or killed
  • $15,000 for damage to someone’s car or property

Most people get their insurance from companies like State Farm or Allstate. But there are other legal options, like:

  • Putting $75,000 down in cash with the DMV
  • Getting a self-insurance certificate from the DMV
  • Getting a $75,000 surety bond from a licensed insurance company

We know insurance can be expensive. But not having it can cost you even more if there’s an accident. That’s why it’s important to be prepared and know your rights–even if you don’t have legal status in the U.S.

What Happens With Insurance After a Car Accident?

After a car accident, the insurance companies are going to get involved–either yours or the other driver’s. There are three main types of insurance claims in California:

  • Injury claim – This is the most common. You or the other driver files a claim to get money for injuries, medical bills, and car damage.
  • Uninsured Motorist (UM) claim – If the driver who hit you has no insurance, you can file a claim through your own policy (if you have UM coverage). It helps cover medical costs and lost income.
  • Underinsured Motorist (UIM) claim – If the other driver has insurance but not enough to cover everything, your UIM coverage (if you have it) can help pay the rest.

Even if you’re undocumented, you have the right to file these claims. The process isn’t always easy, but you are protected under California law.

Why is Dealing With Insurance So Hard?

Insurance companies are businesses. Their job is to pay out as little as possible–even when you deserve more. If you’re undocumented, they may try to take advantage of your fears. But that’s illegal, and you still have rights. That said, here’s how insurance companies often try to avoid paying you fairly:

  • Delaying your claim – They may take too long to respond, ask for too much paperwork, or offer a low amount hoping you’ll just accept it. Sometimes they use your immigration status to pressure you–but you don’t have to accept this.
  • Denying your claim – They might say you didn’t report the crash fast enough or didn’t go to the doctor soon enough. They may try to confuse you with legal language.
  • Defending against your claim – If you push back or file a lawsuit, they’ll fight it. This can take time and effort, but it’s your right. California law says all accident victims, including undocumented immigrants, can file a lawsuit and recover “damages.”

The bottom line is this: you may be undocumented, but your rights after a car accident are real–and worth standing up for. Our team at Maison Law Immigration Lawyers can help you understand those rights and then put you in touch with the right people to deal with the insurance companies and make sure you get what you’re owed.
